Copyright Policy

How copyright works for our plan sets, what infringement looks like, and how to submit or respond to a DMCA takedown notice.

This is version 1.0.0 of the Copyright Policy, effective August 1, 2026.

This policy explains how copyright applies to the house plan sets sold on americanbarndos.com, operated by National Barndos LLC, DBA American Barndos, and how we handle claims of infringement in both directions.

Each plan set is created by a designer of record, an architect or design professional who holds copyright in the plan documents. American Barndos is licensed by the designer of record to sell plan sets to buyers under the license terms in our Plan License Terms. American Barndos does not itself claim authorship of the underlying designs, but does hold rights in the site content, previews, photography, and written descriptions that are not part of the licensed plan documents.

What the law protects

The Architectural Works Copyright Protection Act of 1990 amended federal copyright law to protect original architectural works, including the overall form and the arrangement and composition of spaces and elements in the design. This protection covers two things:

  1. The plan documents themselves — the drawings, sheets, and technical documents, protected the same way any other copyrighted work is protected.
  2. The building as constructed — a structure built from the design is itself a protected architectural work. This means copying a protected design by building an unauthorized structure from it can infringe copyright even if no drawing was ever copied directly.

What infringement looks like in this industry

Common examples include:

  • Buying one plan set and using it to build more structures than your license allows.
  • Sharing plan files with another builder, buyer, or website.
  • Taking a preview or purchased plan and reselling it as your own design, or as a "custom" design with only minor changes.
  • Copying the overall form and layout of a design into a competing plan set.
  • Building a structure that substantially copies a design you never licensed.

If you believe your copyrighted work has been posted, sold, or otherwise used on americanbarndos.com without authorization, send a written takedown notice to our designated agent:

What a takedown notice must include

Under 17 U.S.C. § 512(c)(3), a valid takedown notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it, such as a URL or product page.
  4. Contact information for the complaining party, including address, phone number, and email.
  5. A statement that the complaining party has a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

We will review complete notices promptly, remove or disable access to the identified material where appropriate, and notify the party who posted or sold the material.

Counter-notice process

If your material was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to the same address that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its location before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, phone number, and a statement consenting to the jurisdiction of the federal district court for your address, or if outside the United States, for any judicial district in which American Barndos may be found, and that you will accept service of process from the person who filed the original notice.

Upon receiving a valid counter-notice, we may forward it to the original complaining party. Unless that party informs us they have filed a court action within ten business days, we may restore the material.

Takedowns in both directions

This policy applies whether the claim runs against content on our site or is made by American Barndos against a third party. If we identify unauthorized use of our licensed designs elsewhere, such as on another builder's site, a marketplace listing, or social media, we may send a takedown notice to that platform using the same elements described above, and may pursue other remedies available under law.

Repeat infringer policy

American Barndos will terminate, in appropriate circumstances, the accounts or license access of buyers or users who are determined to be repeat infringers of copyright.
